Examys Platform or Examys Terminal is also known as Examys website ("Website", examys.com) & Examys mobile app (Examys app), (together with the Website, mobile app, the "Service"), are owned by Olangar Solutions Private Limited ("Examys", "us" or "we") having its registered office at Olangar Solutions Private Limited, India, HIG -27, Lane - 4, Dharma Vihar, Khandagiri, Bhubaneswar - 751030. For the purposes of this Terms of Use, accessing of the Platform together with any study material made available or uploaded therein or downloaded, embedded therefrom shall hereinafter be collectively referred to as the services. All the services provided through Examys website or Examys app are properties of Olangar Solutions Private Limited and all the terms and conditions, Privacy Policy & user policy are applicable to any user through Olangar Solutions Private Limited is applicable through Examys (Together the website and app, the “Examys platform” or “Examys Terminal” or “Examys”). This Privacy Policy is applicable to persons who view, browse, or use the Services ("User"). For the purpose of this terms of services, wherever the context so requires "you" or "your" shall mean User or the users and the term "we", "us", "our" shall mean the company, that is Olangar Solution Private Limited or Terminal or platform or Examys or Examys website, or Examys app.

The Term and Conditions are in accordance with the provisions of the Information Technology Act, 2000 ("IT ACT"), Information Technology (Intermediary Guidelines) Rules, 2011, Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 but not limited to the above-mentioned laws, It is also applicable under any Indian law whenever or wherever required and under International laws and orders.

By using or accessing the Platform in any way, including registering on the Platform, using, viewing, sharing, embedding and/or downloading any Services is subject to the following Terms and Conditions of Service ("Terms and Conditions"). By accepting these Terms of Use, you also accept and agree to be bound by Examys Policies, including but not limited to the Examys’ “Privacy Policy” & Examys’ “use policies”.

Our services

We on Examys through mobile or website offers the Services to users to prepare for any examination online through (a) Course e-module (b) Course e-module printed version (c) Test Series e-module (d) Test Series e-module printed version and (e) evaluation services as opted/selected by Users. Courses are presented with different types of educational activities such as Foundation + In-depth course, Previous year paper, Examys ai, Course Journey, Examys inspire whereas Examys Test pass pro+ offers test series such as Mock, previous, Trend and live test.

Once you purchase any Package for any course for a particular duration, you will get access to that particular course. For security reason, you agree that not all parts of the course will be opened all at once. You agree that Examys has sole authority to delete any available Foundation + In-depth course, Previous year pdf discussion, test series and trend analysis by Examys or add any new sections or chapters or lessons, or previous year pdf or test series or trend analysis pdf.

You agree that Examys may, in its sole discretion, and at any time, update, change, edit, suspend, make improvements to or discontinue any aspect of the Service, temporarily or permanently

To avail online courses and course evaluation services, you have to first download our app offered by Google Play store or IOS play store and you may choose to purchase a package (Focus, Power & Combined package) or more on a monthly basis (1 month, 2 months, 3 months, 6 months, 12 months, 24 months) or Annual package (1 year, 2 years, 3 years) through our website and download the Application through a third-party platform like Google play store or other play store. Alternatively, you may purchase a package (Focus, Power & Combined package) or more through our website and then download the related application through our websites, which is linked to the above-mentioned play store.

To avail online test series and its evaluation services, you have to first download our app offered by Google paly store or IOS play store or and download the Application through a third party platform. and you may choose to purchase on monthly basis test pass pro+ (1 month, 2 months, 3 month, 6 months, 12 moths, 24 months) or Annual package (1 year, 2 years, 3 years). Alternatively, you may subscribe to our Services through our website and then download the related Application through a third party platform.

Examys reserves the rights, but not obliged to update or edit the price of any course or course package or test pass pro+ or for any other products or to remove any user content from its website or app or from it associate network or platform or terminal, or from other third platform of Examys for any reason or for no reason.

When you purchase a package for courses or purchase Examys test pass pro+ for test series, payment may be processed by third parties who act on our behalf or directly by the third party platform (e.g. Apple or Google). Rates for services are listed in the Application and in the applicable app store. Examys reserves the right to modify its rates at any time and/or to offer special promotions. Registration/sign up or login of your Account

When you register or sign up or login, you agree with our terms of services and agree with the following details: You agree to give accurate, current and complete information about you and/or your organization. You agree to accept any and all responsibility for any and all activities that occur under your account. You agree to promptly update any registration information you provide to Examys while registering or during your usage of Examys' services

You will keep the confidentiality of your password and other details for the security. You will be contacted via phone calls and/or SMS notifications or e-mails about product details, promotional offer running on websites and app and any offered by the associated third parties even of you have registered yourself under DND or DNC or NCPR service as you still authorize Examys to give you a call for the above mentioned purposes.

You further agree to the contents of the Privacy Policy by setting up the account, You agree to provide your examination registration information for the purpose of our internal estimation. If you do not provide the information, your access to the website content and/or other Examys services may be blocked. No refund will be provided in such scenario. We assure you that we will not use this information for any other purpose or share this information with any third party. User Warranties and Representations

We have our terms of services, privacy policy, and User policies for you for any kind of activities on our platform to avail our services. As a user, you give warrant or you give permission to Examys or you represent to Examys to avail our service is in accordance with our Terms of services, our privacy policy and our User policies and all rules and regulations and all applicable laws of Indian jurisdictions or of all state jurisdictions. In addition, you are liable for any kind of transmission of data or data exported from India or the jurisdiction in which you reside. Lastly, you represent and warrant that, whatever contents (Either you created or owned that content), you grant us a license to use that content. You warrant and represent not only to Examys to avail services but also to our partners, associated third parties service providers to get the services in accordance with our terms of services.

Refund Policy

All payments are non-refundable once the order is confirmed. There is no obligation to provide a refund. However, Examys reserves the right to offer refunds, discounts or other consideration in select circumstances at its sole discretion. s’ “use policies”.

Indemnification of Examys

As a user, your access to or use of the Platform and Services including any use, you agree to defend, indemnify and hold Examys (Olangar Solutions Private Limited) and its directors, officers, contractors, licensors, successors, agents, suppliers, partners, employees, and representatives harmless, from and against any and all claims, losses, causes of action, obligations, liabilities and damages whatsoever, costs including legal fees arising out of or relating to, legal expense incurred during the process, any false representation made to us, your breach of any of these Terms of services, or any claim that any service we provide to you is inaccurate, inappropriate or defective in any way whatsoever or any claim regarding network issue, technical negligence, or server-side issue or related issues that you are unable to access the services. This indemnity will be applicable without regard to the negligence of any party, including any indemnified person.

Liability or damage limitation

We do not represent or guarantee that this Platform will be free from errors. By no means, will Examys be liable for any kind of loss for use our services, inaccurate results, your loss of profits, your business interruption, or your damages stemming from the loss or corruption of data or data being provided inaccurate, the cost of recovering any data or content, the cost of substitute services or claims by third parties for any damage to mobiles, computers, tablets, laptops, or any loss of electronic items, software, modems, telephones or other property or any kind of accident, even if Examys has been advised of the possibility of such damages. In addition, in no event, will Examys be liable to you or any third party claiming on behalf of you whether in contract, tort, strict liability or special or consequential or inability to access data, for the above mentioned causes or activities.

We do not represent or guarantee that this Platform will be free from errors. As a user, your access to avail the services of Examys, including all texts, images, files including audio or video and other content therein, and any other information, property and rights granted or provided to you by Examys are on a normal way. You agree that this Website may be affected by technical glitches, outages, faults or delays, viruses, network issue, server-side issue, programming and coding problem, with the performance or operation of our or another person's software, equipment or systems, traffic or technical difficulties with the Internet or infrastructure failures. Access and use of the service may be unavailable during periods of peak demand, system upgrades, malfunctions or scheduled or unscheduled maintenance or for other reasons. We do not accept responsibility for any loss or damage, however caused (including through negligence), that you may directly or indirectly suffer in connection with your use of this Platform, nor do we accept any responsibility for any such loss arising out of your use of or reliance on information contained on or accessed through this Platform. In no event, Examys does not make any representation or warranty of any kind relating to accuracy, service availability, completeness, error-free content, error-free network or related activities.

Examys does not represent or is affiliated with any government entity. The purpose of this app to help students with their exam preparation. It is not supported by any government organisation/personnel directly or indirectly.

Restriction & Termination

Examys, with its sole discretion, may terminate, block, restrict, disable or suspend your access to all or part of the free Services offered on the Platform and use of the Service immediately at any time, for any reason or with no reason and at such time you will have no further right to use the Service. You may terminate your Examys account at any time by following the instructions available through the Service. The provisions of these Terms and Conditions relating to the protection and enforcement of Examys' proprietary rights, your representations and warranties, disclaimer of representations and warranties, release and indemnities, limitations of liability and types of damages, ownership of data and information, governing law and venue, and miscellaneous provisions shall survive any such termination. Specifically, in case of prolonged inactivity, Examys reserves the right to disable, deactivate or terminate a user's account and the username associated with that account may be given to another user without notice to you or such other party.

Amendments to the Terms of services

When you access Examys to avail our services either fully or partially, you agree that you have read, understood, and agree to be bound by our terms of services, privacy policy and user policies including any future modifications. Examys may edit, amend, update, and change these terms of services published on the Platform from time to time at its sole discretion. The service you access through Examys, include but not limited to content on the website or app such as designs, text, graphics, images, user interface, information, video interface and software, files and their selection and arrangement, e-books, along with the printed version of e-books and may belong to Examys or to its associated partners who have granted Examys the right to use their content and are protected to the fullest extent possible by applicable laws related to copyrights, trademarks, trade secrets and all other intellectual property and proprietary rights. Any unauthorized use of the Services may violate such laws and the Terms of Use. Examys reserves all its legal rights to prohibit, stop or contain any such violations. When you access services of Examys and all the activity data including translated content generated by you generated by you shall be exclusively owned by Examys. Any other trademarks, service marks, graphics and logos, punch line and other related items used with the Service are trademarks or service marks of Examys (Olangar Solution Private Limited) or their respective owners. You have no rights or license to reproduce or otherwise use the Examys name or Examys ai name or Examys inspire name or any Examys or third-party trademarks, service marks, graphics or logos, punch line or any similar names.

Copyright Policy

All the contents we created for the services are genuine and Examys is the legal owner of its all contents and we respect other’s copyrights work. If you believe that your content has been used on Examys in a way that constitutes an infringement of your copyright, please notify Examys designated officer or our agent for complaints or approach us through the procedure set out under the applicable provisions of the Information Technology Act or with the following details in written format: a physical and digital signature of the copyright owner or any authorized person, your copyrighted work details which you think has been infringed, a description that you claim is infringing is located on the Service, proper explanation that we may find it on the Service, Your communication details in which you must include your telephone number, and email address, proper address with pin number, a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner and all the information in your notice is accurate. If you have a good faith belief that your copyright has been infringed by any of our users, you may follow the above process and submit to the above email address.

Governing Law and Jurisdiction

These Terms and Conditions, its subject matter and Examys' and your respective rights under these Terms and Conditions shall be governed by the laws of India. These Terms and Conditions will be binding upon you and all other users. You agree that the courts of Bhubaneswar will have exclusive jurisdiction over any such disputes including contractual or non-contractual concerning these terms.
